General Provisions

1.1 The organizer of the Courses is: The Center for Medical Simulation and Innovation of the Medical University of Warsaw Ltd. with its registered office in Warsaw, address: ul. Żwirki i Wigury 61, 02-091 Warsaw, registered in the National Court Register by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register under KRS number 0000706395, REGON: 368854493, NIP: 7010780339, with share capital in the amount of PLN 1,400,000.00 (in words: one million four hundred thousand zlotys), phone number: 22 572 03 15, email address: biuro@csmiwum.pl. 1.2 The provisions of this Regulation are an integral part of the Application for Participation in the Course and apply to all Participants. 1.3 Detailed information about the Organizer’s courses, their prices, and the payment terms for Course participation are available on the website of the respective Course on the Organizer’s website at the address: csmiwum.pl. 1.4 The Courses are intended especially for: doctors, paramedics, nurses, physiotherapists, and laboratory diagnosticians.

Participation Rules

2.1 The conditions for participating in the Course are:
a) Submitting an Application for Course Participation via the registration form available on the Course’s website by correctly filling in all required form fields and sending it to the Organizer electronically. b) Paying the Course fee as specified by the Organizer to the bank account provided during registration for the specific Course or through electronic payment methods provided by the Organizer. 2.2 A correct submission will be confirmed by a message displayed on the website automatically after filling out the form and a similar message sent to the email address provided by the Participant during the registration process. 2.3 The message confirming the form’s completion is not a registration confirmation for the Course. 2.4 Upon receipt of payment for the Course, the Participant will receive a registration confirmation from the Organizer, entitling them to participate in the Course. The agreement to participate in the Course is concluded when the Organizer sends the Participant the aforementioned registration confirmation. 2.5 The Organizer will issue an invoice for Course participation within 7 business days from the date of payment receipt and send it electronically to the email address provided during the registration process. 2.6 The Organizer reserves the right to refuse a Participant’s participation in the Course if they do not have a registration confirmation sent by the Organizer. 2.7 The number of Course Participants is limited. Participation in the Course is determined by the order of applications. Information about the lack of available seats will be provided by the Organizer on the Course’s website, via email, or by phone. 2.8 Once all available seats are filled, the Organizer will place interested individuals on a waiting list if they agree to have their data processed for future recruitment. 2.9 In the event that a Participant is unable to attend the Course, they may designate a replacement. In this case, the Participant is required to familiarize the replacement with the Course regulations and fulfill the Organizer’s informational obligations attached to the regulations. 2.10 In exceptional circumstances, with prior agreement with the Organizer, advance payments for selected trainings can be made based on a proforma invoice, which will then be credited towards the training fee. 2.11 Participants are responsible for their own expenses related to accommodation at the course venue and transportation. 2.12 Completion of the Course by the Participant will be confirmed with a certificate for participation in the Course issued by the Organizer. 2.13 The Organizer provides appropriate protective clothing for the Course program, lunch, and snacks during coffee breaks. 2.14 The Organizer may include an assessment of acquired knowledge in the Course, passing which is a requirement to receive the certificate referred to in point 2.12 above.

Withdrawal Rules

3.1 Participants can withdraw from participation in the Course before its commencement. The Participant’s withdrawal from the Course must be done by email to: edukacja@csmiwum.pl or in paper form sent to the Organizer. 3.2 In case of withdrawal from the Course as described in point 3.1: a) If the Organizer receives a withdrawal statement earlier than 30 days before the Course commences, the Participant will receive a refund of the paid amount, with a 5% deduction as a penalty. b) If the Organizer receives a withdrawal statement on the 30th day before the Course commences and earlier than the 14th day before the Course commences, the Organizer has the right to withhold 30% of the total fee. c) If the Organizer receives a withdrawal statement on the 14th day before the Course commences or later, or if the Participant does not inform the Organizer of the withdrawal, the Organizer has the right to retain the full payment.

Course Organization Changes and Course Cancellation

4.1 The Course Organizer reserves the right to change speakers and program details for reasons beyond their control. In such cases, Participants are not entitled to a refund. 4.2 The Course Organizer reserves the right to change the Course date. In that case, the Participant has the right to withdraw from the Course, and the Organizer will promptly return the amount paid by the Participant to the bank account specified by them. 4.3 If the Course does not take place due to reasons under the Course Organizer’s control, the Organizer will promptly return the amount paid by the Participant to the bank account specified by them. 4.4 When canceling or rescheduling the Course due to reasons beyond the Organizer’s control, the Organizer is not liable for the Participant’s costs related to travel and accommodation.

Participant Responsibilities

5.1 Participants are fully financially responsible for any damages caused by them. 5.2 The Organizer is not responsible for Participants’ belongings that may be damaged, lost, or stolen during the Course.

Complaints

6.1 Any complaints regarding the Course by Participants should be submitted electronically to the Organizer at: edukacja@csmiwum.pl or by mail to the Organizer’s address. 6.2 Complaints can be filed by Course Participants no later than 21 days after the completion of the Course. 6.3 After the specified period, no complaints will be considered.

Recording of Image and Sound

7.1 Recording the Course proceedings using recording devices without the prior consent of the Organizer and Course instructor is prohibited. The materials obtained by Participants during the Course from the Organizer or lecturer may not be used for commercial purposes, particularly for conducting other courses, without the prior written consent of the Organizer and lecturer. The course content and materials provided to Participants during the Course constitute works within the meaning of the provisions of the Copyright and Related Rights Act of February 4, 1994 (Journal of Laws of 2019, item 1231, as amended in 2020, item 288 and subsequent)). 7.2 The Organizer reserves the right to record events (taking photographs, filming) for informational and promotional purposes related to the activities of CSMI WUM Sp. z o.o. In the case of taking profile pictures, individuals will be asked to voluntarily consent to the processing and publication of their personal data.

Final Provisions

8.1 Submitting a registration form on the Course’s website signifies acceptance of the provisions of these Regulations, as well as compliance with the organizational regulations and any other agreements made in writing or in documentary form between the Participant and the Organizer. 8.2 Acceptance of the regulation’s provisions is tantamount to entering into a contract between the Organizer and the Course Participant. 8.3 If the Course involves the use of anatomical preparations, the Participant also agrees to the “Regulations for Courses on Anatomical Preparations” available on the Organizer’s website and during the Course. 8.4 In case of malfunctioning of the registration system, please contact the Organizer at: edukacja@csmiwum.pl 8.5 Matters not regulated by these Regulations are governed by the provisions of the Civil Code. 8.6 Any disputes arising from participation in the Course will be resolved by the competent court based on the location of the Course organization. 8.7 An integral part of the regulations is the information clause for Course participants

INFORMATION CLAUSE FOR INDIVIDUALS PARTICIPATING IN THE COURSE

Personal Data Administrator

The Administrator of your personal data is CSMI WUM Sp. z o.o. with its registered office in Warsaw (02-091), at Żwirki i Wigury 61. Source and Scope of Processed Data Your personal data (name, surname, professional ID number) may have been obtained by us from a sponsor or another entity that directed you to the course.

Purpose and Legal Basis of Data Processing Your personal data will be processed solely for the purpose of: • conducting activities leading to the conclusion of a contract or implementing the provisions of the contract, in accordance with Article 6(1)(b) of the GDPR, • fulfilling our legal obligation, pursuant to Article 6(1)(c) of the GDPR, stemming from tax regulations – archiving documents related to the contract and the Civil Code, • pursuing our legitimate interests, as specified in Article 6(1)(f) of the GDPR, such as: potential claims or defense against claims, providing the highest quality of service, contact for organizational matters related to the course, providing a list (name and surname) of trained individuals to the training sponsor, as a basis for settlement between us and the sponsor, • sending commercial information, providing the sponsor with your contact information, processing data for the waiting list, registration, and publication of your image, if consent is given, in accordance with Article 6(1)(f) of the GDPR.

Data Recipients Recipients of your personal data may include the Event Sponsor, the Tax Office, postal service providers, a law firm supporting us in legal proceedings in case of claims, and entities cooperating with us in providing services: • for hosting, • for providing IT solutions, software, IT support, and website positioning, • for accounting services.

Data Retention Period Your personal data will be processed for: • 5 years (from the end of the year) in the scope of data for which processing is regulated by law, starting from the end of cooperation, in accordance with Article 74 of the Accounting Act – for individuals participating in the course, • until the withdrawal of consent for data processing, for which the processing basis is consent, • until the limitation of claims or the filing of an effective objection.

Rights In connection with the processing of personal data, you have the following rights: • right to access your data, • right to rectify data, • right to delete data if we process it without legal basis, • right to data portability, for which the processing basis is consent or a contract, • right to limit processing, • right to object, • right to withdraw consent at any time. Withdrawal of consent does not affect the legality of data processing carried out based on consent before its withdrawal, • right to file a complaint with the supervisory authority (UODO) if you believe that the processing of your personal data violates the provisions of the GDPR.

Voluntary Data Provision Providing data is voluntary. Providing personal data is a condition for participating in the course. Failure to provide personal data will result in the impossibility of signing a contract.
